1. Acceptance of Terms

By accessing or using the PokerCoaching.AI mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Eligibility

You must be at least 17 years old to use this App. By using the App, you represent and warrant that you meet this age requirement.

3. Description of Service

PokerCoaching.AI is an educational app designed to teach poker strategy and game theory concepts. The App includes:

• AI-powered coaching and strategy advice
• Hand history analysis tools
• Interactive game theory simulations
• Educational poker games using virtual chips only

IMPORTANT: This App is for educational purposes only. It does NOT involve real money gambling, wagering, or any form of monetary transactions.

4. Account Registration

4.1 Account Creation

• You must provide a valid email address
• You are responsible for maintaining the confidentiality of your account credentials
• You must not share your account with others
• You must notify us immediately of any unauthorized access

4.2 Account Security

• Use a strong, unique password
• Enable two-factor authentication if available
• We are not liable for losses due to compromised credentials

4.3 Account Termination

• You may delete your account at any time via Settings > Account > Delete Account
• We may suspend or terminate your account for Terms violations
• Upon termination, your data will be deleted per our Privacy Policy

5. Subscription Services and Billing

5.1 Subscription Tiers

PokerCoaching.AI offers both free and paid subscription tiers. Paid subscriptions provide enhanced features and increased access to AI coaching services. Subscription details, pricing, and features are displayed in the App prior to purchase.

5.2 Billing

• Subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your selection)
• Payment will be charged to your Apple App Store or Google Play account at confirmation of purchase
• Your subscription will automatically renew unless canceled at least 24 hours before the end of the current billing period
• You can manage and cancel your subscription through your device's app store settings

5.3 Refunds

• Refund requests are handled by Apple (App Store) or Google (Google Play) according to their respective refund policies
• We do not process refunds directly; please contact the respective app store for refund inquiries
• Partial refunds for unused portions of a subscription period are not provided

5.4 Price Changes

We reserve the right to modify subscription pricing. Any price changes will be communicated in advance and will apply to the next billing cycle following the notice period. Continued use of paid features after a price change constitutes acceptance of the new pricing.

6. Usage Limits and Fair Use

Our AI coaching service is powered by third-party AI providers. To ensure quality service for all users and maintain service sustainability, the following usage policies apply:

6.1 Monthly Usage Allocation

• Each subscription tier includes a monthly AI coaching message allocation
• The number of coaching messages available varies based on your subscription tier
• Due to the variable nature of AI responses, exact message counts may vary; we provide approximate ranges (typically 50-150 coaching messages per month for standard plans)
• Unused allocation does not roll over to the following month

6.2 Usage Notifications

• You will receive in-app notifications when approaching your monthly usage limit
• Upon reaching your limit, AI coaching features may be temporarily restricted until your next billing cycle
• You may have the option to upgrade your subscription tier for additional usage

6.3 Fair Use Policy

• Usage that significantly exceeds typical patterns or disrupts service for other users may result in temporary throttling
• Automated, scripted, or bot-driven usage of AI coaching features is prohibited
• We reserve the right to modify usage limits with reasonable notice to users

7. Prohibited Uses

You agree NOT to:

• Use the App for real money gambling or illegal activities
• Attempt to hack, reverse engineer, or disrupt the App
• Use the App if you are under 17 years old
• Create multiple accounts to abuse features or circumvent usage limits
• Share, sell, or transfer your account
• Upload offensive, harmful, or illegal content
• Harass other users or our support team
• Use automated bots or scripts to interact with the App
• Violate any applicable laws or regulations

8. Intellectual Property Rights

8.1 Our Intellectual Property

All content in the App is owned by PokerCoaching.AI or our licensors, including:

• App design, code, and features
• Trademarks, logos, and branding

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, educational purposes only.

8.2 User Content

You retain ownership of hand histories and data you upload. By uploading content, you grant us a license to:

• Process and analyze your data to provide coaching services
• Store your data securely on our servers
• Display your data back to you in the App

We will NOT share your user content publicly or with third parties without your consent.

9. Disclaimers

9.1 "As Is" Provision

ALL PRODUCTS AND SERVICES PROVIDED BY POKERCOACHING.AI, INCLUDING BUT NOT LIMITED TO THE APP, CESOLVER, AI COACHING, AND ALL RELATED SOFTWARE, ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

9.2 No Refunds

All purchases, including subscriptions and software licenses, are final. No refunds will be issued. For app store purchases, refund requests are subject to the respective app store's policies.

9.3 Educational Purpose Only

• The App provides educational content only
• Poker strategies may not guarantee success in real games
• We are not responsible for your poker playing decisions or outcomes

9.4 No Guarantee of Accuracy

• AI coaching is based on general strategies and may not be optimal for all situations
• We do not guarantee the accuracy or completeness of coaching advice
• Game theory content is simplified for educational purposes

9.5 No Endorsement of Gambling

• We do not encourage or endorse real money gambling
• You are responsible for complying with gambling laws in your jurisdiction
• Use of this App does not constitute legal or financial advice

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any indirect, incidental, or consequential damages
• We are not liable for losses resulting from poker playing decisions
• Our total liability is limited to the amount you paid us in the twelve (12) months preceding the claim
• We are not liable for service interruptions, data loss, or third-party actions

11. Indemnification

You agree to indemnify and hold harmless PokerCoaching.AI, its affiliates, and its employees from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of applicable laws

12. Changes to Terms

We may modify these Terms at any time. Changes will be effective immediately upon posting in the App. Continued use after changes constitutes acceptance of the modified Terms.

We will notify you of material changes via:

• In-app notification
• Email to your registered address

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles.

13.2 Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

1. Informal Negotiation: Contact legal@pokercoaching.ai to resolve disputes informally
2. Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration
3. Class Action Waiver: You agree to resolve disputes individually, not as part of a class action

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PokerCoaching.AI regarding your use of the App.
